Social scientists in the bourgeois academy and "Think Tanks" have not paid sufficient attention to the role of law in constituting the economic and coercive institutional regime of capitalism.
In part this inattention is due to an adherence to historically disproven notions of the nature of law in capitalist liberal democracies.
With a few exceptions, the established social scientists in the academy are there because their boundaries of thinking, their resumes and publications conform to the pro-capitalist pro-bourgeois "consensus".

The social scientists approved by the universities do not investigate the roots of institutionalised law and property.
Law and property rights are encoded into statute by capitalist congresses at the behest of their corporate masters with lobbyists as the messengers of class dictate.
In developed capitalist economies, law is sustained through interaction between corporate 'persons', courts and the legislatures. For the bourgeois social scientist, 'the Law is the law' as it were, existing either because it originally sprang forth from the loins of a 'Natural Law' or was devised by the wisdom of great men of democracy's lore. It has only to be "fine-tuned" by new codicil footnotes and clauses .
